Obligation to establish internal reporting offices (up to 249 employees)

The obligation to set up internal reporting points for medium-sized companies (50 to 249 employees) comes into force next week

The Law for better protection of whistleblowers and for the implementation of the directive on the protection of persons who report violations of Union law provides a transitional regulation for private employers with generally 50 to 249 employees for the obligation to set up internal reporting offices, so that they must set up internal reporting points only from 17. December 2023 onwards (ยง 42 Para. 1 HinSchG).

Obligation to set up internal reporting points

Around 5 months have passed since the German Whistleblower Protection Act (HinSchG) came into effect on 2. July 2023. Since then, the obligation to set up internal reporting points for affected companies has applied.

However, so far there has been a transitional regulation for medium-sized businesses with 50 to 249 employees, so that they will only have their internal reporting points to be set up from 17. December 2023.

This transition period for medium-sized companies expires next week, meaning medium-sized companies with up to 250 employees must also set up internal reporting points.
